Returns and withdrawal policy
Right of withdrawal (consumers in the European Union)
If you are a consumer resident in the European Union, you have fourteen (14) days from receipt of your order (or of the last item of a multi-item order) to exercise your right of withdrawal, without giving any reason.
How to withdraw. Inform us of your decision by means of an unequivocal statement (email to contact@futureofgrow.com) before the withdrawal period expires. You may use the model form below, but you are not obliged to do so.
Effects. You must send the products back without undue delay and at the latest within 14 days of your statement. You bear the direct cost of returning them. We will refund all payments received from you, including standard delivery charges, within 14 days of receiving the returned products or proof that they have been sent back. You may be liable for any diminished value resulting from handling other than what is necessary to establish the nature and proper functioning of the product.
Exceptions. The right of withdrawal does not apply, in particular, to products made to your specifications or clearly personalised. Our luminaires do not fall within this exception: the configurations offered, including in the Black Series range, are assemblies of standard components that you select from predefined options, with no custom manufacturing. The right of withdrawal therefore applies to our entire catalogue.
Model withdrawal form
To Sciola Import SARL, Chemin du Châtelard 5, CH-1860 Aigle, contact@futureofgrow.com:
I hereby give notice that I withdraw from my contract of sale of the following goods:
Ordered on / received on: __________
Order number: __________
Name of consumer: __________
Address of consumer: __________
Date: __________
Condition of returned products and diminished value
When exercising a statutory right of withdrawal, the customer may handle the product only to the extent necessary to establish its nature, characteristics and proper functioning, in a manner comparable to what would reasonably be possible when examining a product in a shop.
Merely opening the packaging carefully does not result in the loss of the right of withdrawal where that right applies by law.
However, the customer is liable for any diminished value of the product resulting from handling or use beyond what is necessary to establish its nature, characteristics and functioning.
The following, in particular, may result in diminished value: prolonged use of the product, its installation in a commercial operation or growing facility, signs of use or assembly, scratches, soiling or damage, damage to or loss of the packaging, missing accessories, cables, instructions or other supplied items, and any other alteration that prevents SCIOLA IMPORT SARL from reselling the product in a condition equivalent to that of a new product.
In such circumstances, SCIOLA IMPORT SARL reserves the right, within the limits permitted by applicable law, to deduct from the refund an amount corresponding to the loss of value actually suffered by the product.
This diminished value is determined according to the condition of the returned product, its degree of use, any missing or damaged items and the reduction in its resale value.
The direct cost of returning the goods is borne by the consumer where the consumer has been informed of this in advance, in accordance with applicable law.
The above provisions do not apply to products made to the customer’s specifications or clearly personalised where these are excluded from the right of withdrawal by law.
Returns and exchanges (all customers)
Delivery errors and apparent defects must be reported to Sciola Import SARL within five (5) business days of receipt of the goods. Any damage that occurred in transit must be reported immediately to the carrier and to Sciola Import SARL.
Irrespective of the right of withdrawal, no return is accepted without our prior written consent. For any request, write to contact@futureofgrow.com stating your order number. The goods must be returned in their original packaging, with all their accessories and a copy of the invoice. Where the return results from an error on our part or from a faulty product, we bear the cost of return shipping. Return costs are borne by the customer where the return results from an error on the customer’s part or from transport damage. This last rule does not apply to consumers in the European Union: for them, damage occurring in transit remains our responsibility until the goods are received, including return shipping costs.
Customers resident in Switzerland, like business customers, do not have a right of withdrawal. A return that is not based on a defect, a discrepancy in quantity or a flaw covered by the guarantee is not accepted.
Faulty products
A faulty product covered by the guarantee is dealt with in accordance with section 9 of the T&Cs. The cost of returning a product acknowledged as faulty is borne by FOG.
